The Jar
Terms of useThese Terms are a binding agreement between you and Karen Situ ("we", "us") covering your use of The Jar. By using the app you accept them. If you do not accept them, do not use the app.
Please read section 3 in particular. It is the one that explains what The Jar is not.
You must be 18 or older. By using the app you confirm that you are.
You must be able to form a binding contract, and you must not be barred from using the app under the laws of your country.
You sign in with Sign in with Apple. You are responsible for keeping access to your Apple Account secure, and for everything done through your account.
One account per person. Do not impersonate anyone or use a display name you have no right to use.
The Jar is a record-keeping app for informal agreements between people. You and the people you invite decide on rules, decide on amounts, and decide when you have settled up. The app writes down what you all agreed and shows you the running total.
The Jar is not a financial institution, a bank, a lender, a payment processor, a money transmitter, a debt collector, or an escrow service. Specifically:
If you leave a jar or delete your account, any outstanding balance is cleared, not collected.
Anything you put in a jar — its name, your rules, every violation you report, and any note you attach — is visible to everyone else in that jar, and stays visible to them.
Once the 60-second undo window on a report closes, that entry is part of the jar's history. It can be disputed, but it cannot be deleted or edited, including by us, because it is also other people's record.
If you leave a jar or delete your account, your entries remain in that jar's history, stripped of your identity.
Write accordingly.
Do not use The Jar to:
Reporting. If someone is using a jar to harass or exploit you, block them in Settings → Blocked users, leave the jar, and contact us at karensitu@ymail.com. We review reports and will suspend or remove accounts that break these rules. If you are in immediate danger, contact your local emergency services.
You keep ownership of what you write. You grant us a limited, worldwide, royalty-free license to store, reproduce, and display it — solely so we can operate the app and show it to the other people in your jars. That license ends when the content is deleted, except where it must persist as part of another member's history as described in section 4.
You are responsible for what you write, and you confirm you have the right to write it.
We may remove content or suspend accounts that break section 5.
The app sends notifications about your jars if you allow it. Two of them — the auto-confirm reminders sent 24 hours and 4 hours before a violation confirms itself — will still arrive even when a jar is muted. This is deliberate: muting must not be usable to run someone's balance up while they are not looking. You can turn off all notifications for The Jar in iOS Settings.
The Jar is provided as it is and as it is available. We may change, suspend, or discontinue any part of it, and we may update these Terms. If a change materially affects your rights we will tell you in the app before it takes effect. Continuing to use the app after that means you accept the change.
The app is currently in beta. Expect defects.
You may stop using The Jar at any time and delete your account in Settings → Delete account.
We may suspend or terminate your account if you break these Terms, if we are required to by law, or if we discontinue the app. Where we reasonably can, we will give you notice and a chance to export or settle anything outstanding.
Sections 3, 4, 6, 10, 11, and 12 survive termination.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE JAR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the app will be uninterrupted, error-free, or that any record it keeps is accurate — the records are created by you and the people in your jars, not by us.
We are not responsible for the conduct of other people in your jars, for whether anyone pays anyone, or for any dispute between you and them.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, Karen Situ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR AMOUNTS RECORDED IN A JAR, ARISING FROM OR RELATING TO YOUR USE OF THE JAR.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE JAR WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR US$50.
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
You will indemnify and hold Karen Situ harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the app, your content, or your breach of these Terms.
These Terms are governed by the laws of the United States and of the U.S. state in which we are based, without regard to conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in that state.
If you are a consumer resident in the EEA or UK, nothing here deprives you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there.
These Terms are the entire agreement between you and us about The Jar. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
The following applies to the version of The Jar you obtained through the Apple App Store, and is required by Apple. In the event of a conflict between this section and anything above, this section controls as to the subject matter it covers.
